Various members of the gaming community have watched with mixed alarm, concern, and dismissive amusement as Bethesda has threatened and pursued legal action against Mojang for their use of the video game title Scrolls, claiming copyright infringement upon their own Elder Scrolls?franchise. Acting to attempt to settle the matter (or else deflate?the public?s concern), Mojang?s ?Notch? Persson at first dismissed the situation as negligible, and later, seemingly half-joking half-serious, offered a peaceful solution of a winner-takes-all duel of Quake III. Apparently, Bethesda found the offer less than hilarious.
The matter is proceeding to court for an official lawful settlement. Bethesda, who has remained stoically silent throughout the whole business, has not seen fit to respond to either Notch?s invitation or concerned queries from the gaming public as a whole. Many see this as a classic case of stepping on the little guy, and feel that Bethesda?s Goliath is coming off as more of a bully towards Mojang?s David. Furthermore, Notch has posted some interesting claims on his blog:
We realised we should apply for the trademark ?Minecraft? to protect our brand. When doing so, we also sent in an application for ?Scrolls?. When Bethesda contacted us, we offered both to change the name to ?Scrolls: [some subtitle]? and to give up the trademark.
They refused on both counts.
Whatever reason they have for suing us, it?s not a fear of us having a trademark on the word ?Scrolls?, as we?ve offered to give that up.
